SCAL Academy Seminar :

" WORKPLACE SAFETY ACT & CONSTRUCTION REGULATIONS - IMPLICATIONS FOR CONTRACTORS"

The coming into force of the Workplace Safety and Health Act ("the Act") on 1 March 2006 and the Workplace Safety and Health (Construction) Regulations 2007 which takes effect on 1 January 2008 has a significant impact on the construction industry. To achieve its aim of reducing accidents at workplaces, and inculcating a more vigilant attitude on the part of the stakeholders to implement a safety and health system at the workplace, the Act no longer prescribes the safety and health measures that stakeholders have to implement at the workplace. Instead, the Act has imposed a duty, on all stakeholders including the developer, main contractor, sub-contractor and even the suppliers and manufacturers of machines to be used at the workplace, to take "reasonably practicable steps" to ensure the safety and health of all persons at the workplace. To enable parties to better understand their obligations under the Act and to better elucidate the concept of "reasonably practicable measures", English cases that have interpreted similarly-drafted provisions in the English equivalent of the Act will be discussed. Other topics such as the safety and health management arrangements and enhanced measures of enforcement that have been recently introduced by the Act will also be explained.
